Terms
Not legal advice. This page is a plain-language summary of how Happy Hour HQ operates. If you're making a decision that turns on the legal effect of these terms, talk to a lawyer.
Welcome
Happy Hour HQ is a free public directory of happy-hour deals at bars and restaurants in New Jersey. These Terms govern your use of the site. By visiting, browsing, submitting a bar, claiming a listing, or running an ad, you agree to them.
The service
Happy Hour HQ aggregates publicly-available information about happy hours. We try to keep listings accurate, but we don't visit every bar weekly — deals change, hours change, and the source of truth is always the bar itself. Call ahead if you're driving across town for a specific deal.
Acceptable use
You may:
- Browse the directory and view listings freely
- Submit bars for inclusion (subject to admin review)
- Claim a bar listing as a manager if you operate that bar (subject to verification)
- Place advertising on the site under our advertiser terms
You may not:
- Submit false, misleading, or copyrighted content you don't own
- Impersonate a bar you don't operate
- Use the site to harass any bar, individual, or other user
- Reverse engineer, attack, or attempt to disrupt the service
Automated access and scraping
You may not use any robot, spider, web crawler, scraper, automated script, browser-automation tool, or other automated means to access the site, monitor it, harvest its content, or build a derivative database, except as expressly permitted in our robots.txt file at /robots.txt and subject to a reasonable rate (no more than one request per two seconds, per IP). The robots.txt file is part of these Terms; crawling in violation of it is a violation of these Terms.
If you are a search engine or AI-search provider whose crawler is listed as allowed in robots.txt (e.g. Googlebot, Bingbot, GPTBot, ClaudeBot, PerplexityBot), you may index the site for the purpose of answering user queries and linking back to Happy Hour HQ. You may not: (i) use the indexed content for AI model training (the site's <meta name="robots"> directive declares noai, noimageai), (ii) republish substantial portions of listings without attribution and link-back, or (iii) build a competing directory product from our data.
If you operate a competing happy-hour directory, restaurant aggregator, or hospitality data platform, you may not scrape, mirror, or otherwise duplicate listings from this site, even via headless browsers, residential proxies, or rotated user-agent strings — those circumvention techniques do not change the underlying violation.
Violation of these provisions may result in account termination, IP blocking, civil claims under the federal Computer Fraud and Abuse Act (18 U.S.C. § 1030), state-law claims for tortious interference and unjust enrichment, and DMCA takedown notices against any republished content.
Intellectual property
The site itself — including its curation, ordering, descriptive prose, photographs we have rights to, editorial commentary, design, code, and the compilation of bar listings as a whole — is the property of Happy Hour HQ and is protected under U.S. and international copyright law as a creative compilation (17 U.S.C. § 103) and as proprietary code.
Factual happy-hour data (bar names, addresses, deal items, prices, hours of operation) is not itself copyrightable, but our selection, arrangement, descriptive write-ups, photography, and design are. Reusing our descriptive write-ups, photography, or layout — even with the facts substituted — is infringement.
You retain the rights to content you submit (a photo of your bar, a description you write); by submitting it you grant Happy Hour HQ a non-exclusive, royalty-free, worldwide license to display + redistribute it on the site. This license survives account deletion only to the extent needed to preserve historical accuracy of past versions of your bar's listing.
Bar listings + accuracy
Listings on the site are informational. We can't guarantee that any specific deal will be honored at the bar — that's between you and the establishment. Happy Hour HQ is not responsible for:
- Discontinued or changed happy hours
- Bars that have closed
- Pricing or menu changes
- Bar policies (age verification, dress codes, capacity, etc.)
We update listings based on community reports, manager edits, and periodic admin review. To flag inaccurate info, use the "Report" link on any bar's page.
Bar managers
If you claim a bar listing and we verify you operate that bar, you become a "manager" and gain access to edit your listing. Manager responsibilities:
- Submit only accurate information
- Keep deals + hours up to date
- Notify us within 30 days if you stop operating the bar
- Don't impersonate or grant access to people who don't actually operate the bar
We may revoke manager access at any time if we have reasonable belief that the manager doesn't actually operate the bar or has violated these terms.
Advertisers
Paid advertising is governed by a separate advertiser agreement presented at sign-up. Key points:
- Ads must be for legal bars/restaurants serving NJ
- Ads are visually distinguished from organic listings ("Sponsored" label)
- We reserve the right to reject ad creative for any reason
- Refunds for prorated unused inventory are available within 30 days of cancellation
User-submitted content
When you submit a bar, a photo, a manager edit, or a public report:
- You confirm you have the right to share it (the bar's own photos, your original photography, etc.)
- You grant Happy Hour HQ a non-exclusive, royalty-free license to display the content on the site
- You agree we may edit submissions for clarity, accuracy, or length
- We may decline to publish any submission for any reason
Termination
We may suspend or terminate access to the site or any account at any time for violation of these terms or for any other reason. You may stop using the site any time by closing your browser; manager + advertiser accounts can be deleted on request.
Disclaimers
The site is provided "as is" without warranties of any kind. We don't promise the site will be uninterrupted, error-free, or that listings are perfectly accurate.
To the maximum extent permitted by law, Happy Hour HQ disclaims liability for any loss arising from your use of the site, your reliance on listing information, or your interactions with any bar you found via the site.
DMCA + copyright takedowns
If you believe a photo, description, or other content on Happy Hour HQ infringes your copyright, send a written notice to support@happyhourhq.co with subject "DMCA notice" containing: (i) identification of the work claimed to be infringed, (ii) the URL on this site where the allegedly infringing material appears, (iii) your contact info, (iv) a statement under penalty of perjury that you have a good-faith belief that the use is unauthorized, and (v) your physical or electronic signature. We will investigate and remove infringing material as required by 17 U.S.C. § 512.
Conversely, if you believe a competitor has republished our content (descriptive write-ups, photography, or the compilation as a whole) we welcome reports to the same address.
Indemnification
You agree to defend, indemnify, and hold harmless Happy Hour HQ (and its operator) from any claim, damages, or expense (including reasonable attorneys' fees) arising out of (i) content you submit, (ii) your violation of these Terms, or (iii) your violation of any third-party right, including any intellectual property or privacy right. This survives termination of your account.
Governing law
These terms are governed by the laws of the State of New Jersey, without regard to conflict-of-laws principles. Any disputes will be resolved in NJ state or federal courts in Essex County.
Changes
We may update these terms occasionally. Material changes will be announced via a site banner for at least 30 days. Continued use after changes means you accept the updated terms.
